How does the legal process work?

When you have been wronged, our legal system may allow recovery from the person who caused you damage.  One tool to enforce your rights is a lawsuit.  A lawsuit is a civil action brought before a court of law in which a plaintiff, seeks a legal or equitable remedy against a defendant who has caused plaintiff damages.  A Plaintiff files a complaint in either federal or state court which states the factual and legal basis for the complaint and the damages requested.  The defendant is required to respond to the plaintiff's complaint.

If the plaintiff is successful, judgment will be given in the plaintiff's favor, and a range of court orders may be issued to enforce a right, award damages, or impose an injunction to prevent an act or compel an act.

The conduct of a lawsuit is called litigation.  We have prepared some flow charts below that explain the general process of how a case flows through the legal system.  Below is a Federal Civil Case Flowchart.  If you have any questions please contact us.  Remember, MinCal's lawyers are here for you. We're always a phone call away and offer free consultations.
